Fires-Cookers

The site is provided to you for your personal use. When ordering through the site, you may be bound by these Terms and Conditions.
 
These Terms and Conditions may be amended from time to time and such amendments will come into force on the first day of the month following the month of amendment.
 
Please read and make sure you understand the Terms and Conditions.

1. You should read our Private Policy in conjunction with these Terms and Conditions. We may at any time make changes to the site and the details (including prices) displayed on it.

3. We may from time to time establish relationships with other companies (e.g. our suppliers) that will enable you to access their web sites. Each of these companies operates its own privacy policy and we cannot be held responsible for information gathered by them about you on their site. You must access such sites at your own risk in this respect.

4. Working days means Monday to Friday each week but excluding statutory holidays. Before working with electricity or gas, and experienced professional, a qualified electrician or Gas Safe registered fitter should be consulted. The instruction manuals and safety notices that accompany the products ordered should always be read and understood before fitting or connection is attempted. No gas or electricity connection should be attempted without the involvement of an appropriate professional.

5. To order goods through the site you must be at least 18 years of age.

6. Each order by you represents an offer to purchase goods subject to these Terms and Conditions. Delivery is free to Mainland UK on working week days, but a delivery charge will apply to weekend deliveries.

7. All prices are shown in £ sterling and include VAT, delivery charges to England, Wales and Scotland (see section '6' for exclusions). We will endeavour to take all possible care to keep all details of your order and payment secure. However, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering.   

We reserve the right to change any advertised prices at any time. The price you pay is the price displayed on this web site at the time we receive your order, except in the instance where an error has occurred with the data making up the information, which is projected through the web site. In the event that an error is discovered with the price of any goods you may have ordered we will inform you as soon as we can possibly contact you, whereupon we will give you the option of amending and processing your order at the correct price or cancelling it.

In the possible event that we cannot contact you by phone, we will write to you and ask if you wish to continue or cancel your contract. If after 14 days from posting of the letter we have had no response we will treat the order as cancelled. If you cancel and you have already paid for the goods, we will give you a full refund that will be processed immediately.
 
8. All product information shown on the web site is believed to be correct and accurate from the source material. Please inform us if you believe any information not to be correct, and if this affects your order we will endeavour to correct this until all parties involved are satisfied.  However, specifications and dimensions are for guidance only.  Please refer to manufacturer’s website for full product specification.
 
9. Payment can be made by most major Credit Cards or any Debit Card. Full payment for your goods is taken when a new order is created.
 
If you’re using an alternate delivery address to the one registered with your payment card, then an additional security check will have to be done to prevent fraud. This may cause a short delay with your delivery.

10. As soon as the goods are delivered to you, they become your responsibility. We will deliver only to the address on the order and goods will not be left without a signature.

11. Faulty goods must be reported to us within a reasonable period of time, as soon as possible after delivery so that arrangements can be made for the return of the goods and for the goods to be exchanged or to refund you in full within 30 days of notification.
 
Any goods which are not faulty and are being returned under the 7 days cancellation period must be undamaged; in the same condition as supplied; with no parts missing and in full working order. If goods which are non-faulty are returned to us and they are found to have items missing; are damaged; or not in a saleable condition due to your failure to take reasonable care of them you will be liable for any costs or consequential costs incurred.

 A collection charge will be incurred for items being returned under the seven day cancellation period.  For small appliances i.e. hobs and small fires, a charge of £24.99 will be required.  For larger appliances over 25kg i.e. cookers, washers and larger fires the charge will be £49.99.  

Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel your order within seven working days  after the day of delivery, without giving a reason. The customer has the choice of returning the goods via his/her own means, or requesting a collection, in which case the cost of returning the goods to us will be deducted from the refund. Charges are explained in the paragraph above. This charge may also be incurred if you cancel your order after the goods have left the warehouse, or you cancel after a failed delivery.
 
12. Damaged goods must be reported within 72 hours of delivery. Where possible in cases of goods received damaged please retain the product together with any packaging) and contact us within 72 hours of receipt by e-mail.  This does not affect your statutory rights as a consumer.

In the case of any item being faulty we require an inspection by a manufacturers qualified engineer to be carried out on the item where it is installed so we can ascertain the fault before we can arrange for a replacement.
 
Do not install any damaged or unwanted items.

Where goods (whether faulty or non-faulty ) are being returned, please contact us to let us know so that arrangements can be made for the return of the goods. Where it has been agreed that we will collect the non-faulty goods from you, your credit or debit card will be charged with the actual cost of carriage incurred by us, including the collection of non-faulty goods. To avoid the goods being damaged during transit (especially when being returned by you) we recommend you pack the items in the original packaging where possible.  Where faulty goods are to be returned, then we will either reimburse you the cost of the carriage (please retain you invoice as proof of payment) or we will collect the faulty goods free of charge. All goods in your possession must be treated with reasonable care.

13. It would be preferred if reports of damage or incorrect items sent were reported in either writing or by email to Fires-Cookers.
 
14. Delivery will usually be within 5 - 10 working days depending on the product that has been ordered and stock availability. A signature will be required. If any delays in delivery should occur the consumer will be notified, and if we are not able to deliver within either 30 days or in any other prior agreed time to the consumer, the consumer would be given the option to continue with the contract or cancel it.

15.  Delivery is door to door only. Large items such as Range Cookers or Fridges will be taken up a maximum of 3 steps when delivered on our own vans, couriers only deliver to the doorstep, all deliveries are sent by one-man delivery.

16. We will only deliver to ground floor properties. Please call us if this affects your order, as undelivered products caused by this problem will incur a re-delivery charge. After you have paid for and signed for receipt of the goods, you will be their owner. Whilst our own drivers (green day deliveries) are quite happy to wheel your product into an unobstructed room of your choice, we cannot be held responsible for any damage incurred. For example, it is the customer's responsibility to protect any floor coverings to prevent damage while the products are being situated in the property. 

17. We strongly advise all consumers not to book fitters until they have received the relevant goods, as no claims will be accepted.

18. Where a pre-arranged agreed day has been given for a delivery and that delivery fails due to there being no one at the address to sign for the goods, then the customer may be liable to pay £24.99 re-delivery charge (or £49.99 for items over 25kg i.e. cookers, washers and larger fires).  This charge may also apply if you cancel a delivery after the goods have left our warehouse.  If you wish to cancel you order after a failed delivery you may be required to pay a cancellation charge of £24.99 (or £49.99 for items over 25kg i.e. cookers, washers and larger fires).
 
Re-delivery or cancellation charges may also be charged in the event that a delivery fails due to parking restrictions or other access problems (e.g. stairs or narrow doorways) that you fail to notify our telesales operators of. By booking your own delivery date at the checkout you are agreeing that there are no access or parking restrictions that we should be aware of.

19. You must notify us of non-delivery of expected orders as soon as possible.
 
20. We will email an order summary to you if you have given us an email address, otherwise a copy will be mailed to the supplied billing address.

21. All products are subject to availability and may be changed at any time. If your order cannot be fulfilled you will be offered an alternative or given a full refund. Payment can be made by most major credit cards (except American Express and Diners Club cards). We also accept any debit card. Full payment for your goods is taken when a new order is created.
 
If an order is received for a discontinued product we will provide the up-to-date equivalent automatically, providing it is available and at the same price as the discontinued model. If this is not the case we will contact you.

22. If, in the unlikely event you wish to make a complaint, please contact us in writing to the address shown on our contact page. We will respond in writing to all complaints within 5 working days and will keep you fully informed throughout the process by your request.
 
23. All items carry a minimum twelve months part and labour guarantee issued by the manufacturer, which is subject to provisions that the appliance has:
 
a) Been used solely for domestic purposes and is on domestic premises; i.e. not for commercial or trade use.

b) Been used solely in accordance with the instruction book.

c) Not been subject to misuse, accident, modified or repaired by anyone other than the manufacturer's service engineers.
 
Some manufacturers do offer extended guarantee as a promotion and others offer them for a small fee. We do not offer extended warranties however, certain credit card companies may be able to provide this service to their cardholders.

24. All 'Living Flame Effect Gas Fires' that are sold on our website are sold as secondary heating appliances as a backup to the main central heating. Please refer to manufacturers own website for specific information.
 
25. All prices include a credit card charge of 2%.  This charge is non-refundable for refunds if goods are cancelled due to no fault of fires-cookers.
 
26. Images of products are taken from manufacturers web sites and are for illustration purposed only, products may differ slightly if the manufactures website is not up to date.
 
27. When selecting the “remove packaging” option please be aware that the item will only be brought into the house if there is no more than 3 steps and that access is clear to do so.
 
28. When selecting the “remove old appliance” option please note that the item must be uninstalled and ready for the driver to take when he arrives. The removal charge is non-refundable.
 
None of the above affects your statutory rights as a consumer. We reserve the right to amend our terms and conditions clauses wherever consumer statutory rights are not affected.

Store voucher – Terms and conditions

1) Limit one promotional voucher per person, per offer and one promotional voucher per order.

2) This promotional voucher may only be redeemed toward the purchase of products listed in The Gas Superstore online catalogue sold by The Gas Superstore or in our showroom or telephone sales service.

3) Please note that a minimum purchase value may apply which is exclusive of postage and packing.
